I listed my SuperChips MicroTuner 1705 for 1994-2003 PowerStroke 7.3L trucks/Excursions on eBay. I am selling it because I lucked out and found a DiabloSport experimental "Revolution" chip and have installed it instead of the MicroTuner (the Revolution chip isn't out yet, but more on that later--http://www.pdqperformance.com/pdqstore/news.phtml?nk=9).

SuperChips notified eBay that by selling my used tuner I was infringing on their patents, trademarks, and copyrights. eBay then pulled my auction (as they did all other auctions for SuperChips products--new or used). I won't go into the battle I'm engaged in them with over this, but I am selling the 1705 tuner for $290 including shipping to the first buyer. It is used, like new int he original box with all the paperwork, etc.

WOW !!!
Superchips is taking a HARD (and BAD, in my opinion) line on the resale on eBay...
I really question their logic in this - both from a legal standpoint and a marketing standpoint !!!
Even Computer software can be resold if the original licenses and all go with it !!!

I wonder what their attitude would be if you were selling this to buy an upgraded superchips product?

Interested to know how this comes up...
WILL influence my decision whether or not to buy something that I can NEVER resell if I want an upgraded item - even from the same manufacturer ?!?!

Sometimes you wonder if some management decisions are made COMPLETELY in a vacuum ?!?

Question for you SCMT 1705 users:
I have read that the 1705 will read the fault codes, but will it also let me see the sensor values?

To follow up on the Superchips hassles, they were complete jerks on the phone. Wouldn't see my point of view, told me to take them to court if I wanted to, and told me that reselling my MicroTuner on eBay was a violation of their trademark and copyright (I spoke with the Customer Service manager "Al" and the Vice President, neither of whom would provide their last names--they told me to look it up on their corporate records from the State of Florida--nice, huh?).

They did tell me that I was free to sell the tuner anywhere else, just not on eBay. They also said that they will continue to request that eBay pull any auction listing one of their products--used or not. For my part, I simply relisted the tuner and sold it a few days later, but I did so at the risk of eBay closing my account. For eBay's part, they were very understanding and offered to let me submit a counter-affadavit to have the item relisted. By the time it was all said and done, I had already sold the tuner.

Buyer beware.

Dear Mr. Jacobson,

I recently listed a SuperChips brand engine tuner on eBay and the
auction was terminated early at the request of SuperChips through the VeRO
program. No explanation was given other than a general "your item infringes their
copyright, trademark, or other rights." SuperChips does not have an
"About" page on the VeRO site that offers any explanation, either.

In fact, this item was listed in a manner that does not infringe on
SuperChips copyrights, trademarks, or "other rights". I purchased this
item from a legitimate SuperChips dealer at retail, found that I no longer
had a use for it, and now want to sell it as used (and at a loss, I might add)
through my eBay account, just as I might sell a used computer, book, or
even a car. Nothing in my purchase of SuperChip's product legally restricts
me from selling it when I have no further use for it. I did not license the
product--I purchased it outright. There was no "by opening you agree to
our terms and conditions" on the product packaging or included with the
product. There was no restriction on reselling my used purchase at a later date.

I did not make any claims in my auction listing that indicated in any
manner whatsoever that I was selling a new item or that I was a SuperChips
dealer. I also did not post any images with the item, therefore there was no
copyright violation. In short, I simply listed a used item on eBay and
without proper review, my auction was ended early.

Mr. Jacobson, I can clearly understand the motivation by SuperChips to
limit the unauthorized sale or misrepresentation of their products by persons
who would mislead prospective buyers or offer for sale copyrighted
materials, such as software or illegally copied CD's. I can also understand eBay's
efforts to limit your liability as a conduit for the infringement of the
rights of others. In this case, however, the item was used and clearly
described as such and offered for sale by a private party. Is it really
eBay's intent to allow manufacturer's of durable goods the freedom to
restrict the sale of used merchandise? To what extreme can that be
taken? Can Ford restrict my right to resell my Mustang on eBay? The issues in
this case are the same. I purchased a product and now want to sell it as
used.

While I applaud eBay's assistance to copyright and trademark owner's in
the enforcement of their rights, more oversight must be provided to prevent
the abuse of the VeRO program by companies such as SuperChips.

What will eBay do to protect MY rights? I want my auction reinstated.

I don't see how selling it on Ebay is any different than some other auction site. That doesn't make any sense.

That is horrible customer service as well, sorry you had to run into those problems. You'd think in today's market they would take into consideration that you were probably going to voice your concerns over the way you were ttreated in a discussion forum where hundreds of other people will read about their service. Regardless, that shouldn't be what persuades them to offer good customer service.

Oh well, at least you were able to sell it.

Not only did I mention the SuperFord forums, but when they gave me such a hard time and refused to even provide their last names, I told them exactly what I intended to do on the 'Net. Made no difference at all. Total jerks.

I have a stock 7.3 with no mods other than a KN airfilter. Do the tuners need to have a 4in exaust and if so what do you recomend? Does the Tunner cause any problems with the engine or have you had any warranty voiding issues with it? My Gas millege sits below most of what I have seen posted and would like to see some improvements on it. Has the tunner helped with that also?
To let everyone know I have made it back from Iraqi Freadom and now sit deployed in Germany waiting the ok to take my company Home. Maybe by the middle of July. Got all the soldiers back without any injuries, thank GOD.

Wade, glad to hear you all will be making it back safely.

With regards to gas mileage...I'm starting to think that the more miles you get on a PSD, the better your mileage will be. This morning I noticed that I'm at about 1/2 a tank on the fuel gauge and have 370 miles on the tank so far. That's nearing 17 MPG. My X is my daily driver through rush hour in the morning/evening in Minneapolis and I haven't been trying to baby it to squeeze out an extra MPG. I think it's getting better with age/mileage.

When I installed my chip and exhaust, I noticed a 1-1.5 MPG increase. Of course that was about a month after I installed it because the first month is spent romping on the pedal because it's so much fun to get these things moving so quickly!

lol i installed the TTS flip chip in my X,have been giving all my friends and customers rides,and i cant understand why my mileage went to 11mpg on the 100hp setting

I bought the 1705 and I felt the difference right away!!!! I just goes now my wife even says she sees a big difference too. We pull a 30 ft travel trailer and it never kicks down even going up steep grades. When your cruising 60 65 and you step on it you better be watching the speedometer it will be at 80 to 85 in no time flat. I am only using the safetow program now and those are my results. Love the programer and it was really easy to set it up.
