I am going through the same nightmare right now. My 2003 6.0 PSD sheared the flexplate bolts off at 16,000 miles because it has .200" crankshaft endplay. Ford flatly denied the warranty due to "the presence of aftermarket parts" and said that the Mag-Moss Act " doesn't apply to them". I've contated the Colorado attorney generals office and the BBB but no response yet. Gale Banks and SEMS have sent me lots of info but whatever I say, the service manager at the dealer says I'm basically screwed because Ford doesn't reverse decisions" and a new shortblock install will be $8,000. |

Magnuson-Moss Act
US Code - Title 15, Chapter 50, Sections 2301-2312
Legally, a vehicle manufacturer cannot void the warranty on a vehicle due to an aftermarket part unless they can prove that the aftermarket part caused or contributed to the failure in the vehicle (per the Magnuson Moss Warranty Act (15 U.S.C. 2302(C)) . For best results, consider working with performance-oriented dealerships with a proven history of working with customers. If your vehicle manufacturer fails to honor emission/warranty claims, contact EPA at (202) 260-2080 or www.epa.gov . Right on, This is exactly the hinge point of my dispute. In the closing minutes of my hearing, the examiner was shuffling through the paper work and commented that without the old parts, how do we know what caused the failure and who's responceable. Yes, the burden of proof is souly on the dealer. Not because they see mods!!!! |

This is all completely true except for the fact that Ford says it does not apply to them, end of discussion. They did not even authorize tha dealer to pull the oil pan and try to find out WHY my truck had .200" crankshaft endplay. |

They are wrong!! Get the info from Banks on there system not exceding ford specs and take that to the BBB. I don't feel that your mod is a caricturistic of a end play issue. Ford will reply by fax and you get to make a personal presentation which has far more impact than a canned fax message. If you get a good arbitrater he will see that Ford has no proof of your mod's causing the end play. Thats how the law reads and you should work that into your presentation. Ford is bound by the BBB's decision. |

The problem is, they won't listen! They say it's my fault and that's the end of it. Period. I just about have no one else to plead my caes to because I haven't heard back from the attorney generals office or the BBB yet. |

I don't remeber if I asked you about the distric rep from Ford. Have you contacted him? I read in the warranty book that he is there to help. Maybe if you could show him the Banks data that the mod keeps the engine to Ford spec. Its a long shot but another angle. It my case, It was a good ole boy deal. I had an invoice showing what it took to correct the truck but the dealer wouldn't flat out write on letterhead that the first dealer screwwed up. I don't know where you are Mike but I have a nation wide expert in town. He has a radio program for RV's and does mods for the dealer I just beat. I think Chuck or Mike would give you an honest opinion. Your mods don't cause endplay. You type of mod when totaly abused mite stretch the head bolts and blow the gackets but Banks has protection built in so that can't happen. The ford dealer has to have "proof", the hinge point of your dispute to turn this around to you. Give the guys at "thepowershop.com" Chuck owns the place and his son Mike is in the office with him. Keep me up to speed. I don't know if I came help but powershop is 10min away. |
